These Terms & Conditions explain the rules that apply when you visit XS650Direct.com, use our website, or place an order with us.
XS650Direct.com is operated by 1781329 Ontario Inc.. In these terms, “XS650Direct,” “we,” “us,” and “our” refer to XS650Direct.com and 1781329 Ontario Inc. “Customer,” “you,” and “your” refer to the person using the website or placing an order.
1. Acceptance of These Terms
By using this website or submitting an order, you agree to these Terms & Conditions and to the policies incorporated or linked from this website. If you do not agree, please do not use the website or place an order.
You must have the legal capacity to enter into a purchase agreement. If you place an order for another person or business, you confirm that you are authorized to do so.
Using the website, accepting these terms, placing an order, or contacting us does not, by itself, create express consent to receive marketing communications where applicable law requires separate consent. Marketing, tracking, and privacy practices are addressed below and in our Privacy Policy.
2. Orders and Order Acceptance
Orders are placed through the online store. There is no minimum order unless a promotion, product, shipping method, or checkout rule expressly states otherwise.
Submitting an order does not automatically mean that we have accepted it. An order is an offer by the customer to purchase the listed products. An automated order confirmation only confirms that we received the order.
An order may be accepted after it has been reviewed, payment has been approved, and the order has entered fulfillment or been shipped.
We may remove an unavailable item, adjust an incorrectly entered quantity, divide an order into separate shipments, or partially cancel an order. If this occurs, we will refund the amount paid for any cancelled item and any applicable related charge.
If we cancel an entire order, we will issue a refund to the original payment method. We will not charge a higher price for an affected product without the customer’s authorization.
We may contact the customer to verify identity, payment information, billing or shipping addresses, Yamaha XS650 application, or other order details. We may hold or cancel the order if reasonable verification cannot be completed.
3. Payment
Payment must be successfully authorized before an order is fulfilled. PayPal eCheck or other delayed-settlement payment methods may be held until funds have cleared.
Money orders and paper checks are not accepted unless we expressly agree otherwise in writing.
The customer confirms that they are authorized to use the submitted payment method and that all payment and billing information is accurate.
4. Customer Changes and Cancellations
Orders move into processing quickly. We cannot guarantee that an order can be changed, combined, redirected, or cancelled after it is submitted.
Contact us immediately if you notice a mistake. If the order has not been processed or shipped, we will try to help. Once an order has entered fulfillment, the applicable return process may be required.
5. In-Store Pickup
In-store pickup may be available. Contact our customer-service team before arriving so that the order can be prepared and pickup arrangements can be confirmed.
If shipping was charged on an order that is subsequently approved for pickup, the applicable shipping charge may be refunded after the pickup is completed. Pickup availability, timing, and refund handling may depend on the order status and payment method.
6. Product Information and Website Errors
We work to keep product descriptions, fitment information, photographs, prices, quantities, inventory, dimensions, specifications, and availability accurate. However, typographical, technical, supplier, data-entry, and display errors can occur.
We reserve the right to correct website information at any time and to cancel an affected order before shipment. If a product was listed at an obviously incorrect price or with materially incorrect information, we are not required to supply it on the incorrect terms where permitted by law.
Product colours, finishes, markings, packaging, and minor details may differ from photographs because of lighting, screen settings, manufacturing variations, supplier changes, or production updates. Minor non-functional differences do not necessarily mean that a product is defective.
7. Prices, Currency, Taxes and Promotions
Prices may change without notice. The price shown during checkout, subject to correction of errors, is the price used for the order.
Customers are responsible for applicable sales taxes, duties, import charges, brokerage fees, or government assessments unless the checkout, shipping offer, or published shipping policy specifically states that we will pay them.
Banks and payment providers may apply currency-conversion rates or additional fees. These charges are controlled by the payment provider and not by XS650Direct.
Free-shipping, tariff, gift-card, discount, and other promotional offers apply only under the conditions displayed at the time of purchase. Promotions may be corrected, changed, or withdrawn for future orders.
8. Yamaha XS650 Fitment and Compatibility
Yamaha XS650-family parts can differ by model, model suffix, year, production date, market, brake setup, wheel style, engine, carburetor, ignition system, electrical system, controls, bodywork, and original equipment configuration.
XS1, XS1B, XS2, TX650, XS650 Standard, and XS650 Special applications are not automatically interchangeable. Customers must read the complete product description and verify the exact model and year before ordering.
Do not assume that a product fits solely because it resembles the original part or because the motorcycle falls within the same model family.
A reference to a Yamaha OEM number is provided for identification or cross-reference purposes unless the product is specifically identified as genuine Yamaha OEM.
Unless expressly confirmed otherwise in writing, customer-service advice is based on information supplied by the customer. Incorrect, incomplete, or inaccurate motorcycle information may result in an incorrect recommendation.
The customer is responsible for identifying engine swaps, carburetor changes, ignition conversions, charging-system changes, brake conversions, wheel changes, frame changes, aftermarket components, or other modifications that may affect compatibility.
Universal and Custom Parts
Products described as universal or custom are not guaranteed to bolt directly onto every Yamaha XS650. They may require measurement, fabrication, wiring changes, brackets, adapters, spacers, tuning, modification, or professional installation.
The customer is responsible for checking all dimensions, specifications, mounting requirements, electrical requirements, and legal restrictions before purchasing or modifying a universal or custom product.
A product that has been installed, wired, cut, drilled, painted, altered, fueled, oiled, marked, or otherwise modified may no longer qualify for a return.
9. Installation, Inspection, Maintenance and Assumption of Risk
Motorcycles, replacement parts, repairs, restorations, modifications, racing, and off-road operation involve inherent risks. Incorrect selection, installation, adjustment, maintenance, or use of a product may cause product failure, loss of motorcycle control, property damage, serious personal injury, or death.
Before installation, the customer or installer must confirm that the product is correct for the motorcycle and intended application. Every product must be inspected for damage, defects, missing components, shipping damage, and proper fit before it is installed or used.
Do not install or use any product that appears damaged, defective, incomplete, incorrect, or unsuitable. Contact XS650Direct before installation if there is any uncertainty.
Products must be installed, adjusted, tested, inspected, and maintained correctly using the applicable Yamaha factory service manual, proper tools, current specifications, and recognized motorcycle-repair procedures. Instructions supplied with a product do not replace the factory service manual or the professional judgment of a qualified motorcycle technician.
Installation should be performed by a qualified motorcycle technician whenever the customer does not have the necessary knowledge, experience, tools, or equipment.
Brake, steering, suspension, wheel, tire, fuel, throttle, engine, drive, ignition, charging, and electrical components are safety-critical. Installation, adjustment, and inspection of these systems require particular care.
After installation and before operation, all work must be inspected and tested in a safe and appropriate manner. Fasteners, adjustments, clearances, fluid levels, leaks, electrical operation, braking operation, steering, chain adjustment, and other affected systems must be checked as appropriate.
Products and affected systems must be periodically inspected, adjusted, and maintained after installation. Stop operating the motorcycle immediately if a defect, unusual operation, warning sign, or unsafe condition becomes known or reasonably apparent.
10. Electrical and Charging-System Parts
Electrical problems may be caused by wiring faults, poor grounds, corrosion, loose or overheated connectors, incorrect batteries, charging faults, failed components, excessive loads, or previous modifications. Replacing one electrical component does not necessarily correct the underlying fault.
Before installing an electrical component, related wiring, connectors, grounds, battery condition, charging output, resistance, polarity, and connected components must be properly tested where applicable.
Electrical products must not be purchased or installed as diagnostic tools. Incorrect testing, wiring, polarity, grounding, voltage, overloading, or an unresolved system fault may immediately damage a new component.
Electrical products may be excluded from ordinary returns where stated in the product listing or Return Policy, except where the product is defective, we supplied the wrong item, or applicable law requires a remedy.
11. Exhaust Systems, Chrome and Finish
Exhaust systems are covered only by the written warranty applicable to the product. Warranty coverage does not include damage caused by impact, incorrect installation, modification, misuse, exposure to corrosive substances, weathering, ordinary wear, neglect, or another cause outside a manufacturing defect.
Bright chrome exhaust components are not guaranteed against heat discoloration, bluing, staining, or finish changes caused by engine condition, carburetion, ignition timing, operating temperature, fuel mixture, use, or environmental exposure.
Warranty returns for exhaust systems may require prior authorization and return of the complete product and supplied hardware.
12. Wear Items and Motorcycle Vibration
Cables, rubber components, bulbs, filters, contact points, brake friction materials, seals, and similar service items are subject to wear and are not guaranteed against normal deterioration or service life unless a defect is shown to have existed before installation or applicable law requires a remedy.
Motorcycle vibration, incorrect mounting, worn mounts, loose hardware, structural defects, impact, and continued use after a problem appears may contribute to fatigue or failure of mirrors, lamps, brackets, frames, and other components. The motorcycle must be inspected and maintained accordingly.
13. Racing, Competition and Off-Road Use
Racing, competition, stunt, and off-road use place greater loads on motorcycles and components and involve additional risk. Unless a product listing or written warranty expressly states otherwise, products are not represented as suitable for professional racing or competition.
Products marked “off-road use only,” “competition use only,” or similar wording must not be used on public roads where prohibited. The customer is responsible for compliance with applicable road-use, emissions, noise, equipment, registration, and vehicle laws.
Warranty coverage may be excluded for racing, competition, stunt, or off-road use where the applicable product warranty or listing states such an exclusion, subject to applicable law.
14. Shipping and Delivery
Shipping dates and delivery estimates are estimates and not guarantees unless we expressly agree otherwise in writing. Delays may occur because of carriers, weather, customs, address problems, labour disruptions, emergencies, or other circumstances outside our reasonable control.
Customers are responsible for providing a complete and accurate delivery address. Additional costs caused by an incorrect address, refused delivery, unclaimed shipment, or unauthorized redirection may be deducted from a refund or charged to the customer where permitted by law.
Orders may be divided into more than one shipment. Current shipping methods, delivery estimates, tracking conditions, duties, tariffs, and promotional shipping terms are described in our Shipping Information.
Missing, Damaged or Incorrect Shipments
Inspect the package and its contents promptly after delivery. If an item is missing, damaged, or incorrect, contact us as soon as reasonably possible.
Keep the product, packaging, shipping carton, labels, and packing material because photographs, documentation, or carrier inspection may be required.
15. Returns and Refunds
Returns are governed by our Return Policy and must be started through our Return Centre.
Unless a different written rule applies, return requests must be made within the period stated in the Return Policy, return authorization is required before shipment, and returned products must meet the published condition and shipping requirements.
Installed, used, modified, damaged, marked, contaminated, dirty, incomplete, or incorrectly returned products may be refused or receive a reduced refund, except where applicable law requires another remedy.
Customers are responsible for return shipping unless we agree otherwise in writing or applicable law requires reimbursement.
Refunds are processed after the returned product is received and inspected. Payment-provider processing time may affect when a refund appears in the customer’s account.
16. Warranties
Unless a different written warranty is provided with a product or in its listing, general merchandise is warranted for 90 days from the retail sale date against manufacturing defects in workmanship or material, subject to the exclusions below and applicable law.
Warranty remedies are limited to the repair, replacement, refund, or other remedy stated in the applicable written warranty or required by law. Warranty claims may require proof of purchase, photographs, testing information, installation details, return of the product, and other information reasonably needed to assess the claim.
Warranty coverage does not apply to ordinary wear, misuse, incorrect fitment, improper installation, neglect, accidents, racing or off-road use where excluded, unauthorized modification, improper maintenance, corrosion, unresolved electrical-system faults, or damage caused by another failed component, except where applicable law provides otherwise.
The installation of a replacement component does not correct an underlying fault elsewhere on the motorcycle. The customer or installer is responsible for identifying and correcting the condition that caused the original component to fail.
Any legal warranties or consumer rights that cannot lawfully be excluded remain in effect.
17. Disclaimer and Limitation of Liability
To the fullest extent permitted by law, products and website information are provided without guarantees beyond those expressly stated in writing or required by applicable law.
Technical information and customer-service guidance are general information based on the details available to us. They are not a substitute for physical inspection of the motorcycle, the applicable Yamaha factory service manual, or the judgment of a qualified motorcycle technician.
To the fullest extent permitted by law, XS650Direct and their owners, directors, officers, employees, representatives, suppliers, contractors, and service providers will not be liable for:
- Personal injury or death arising from improper product selection, installation, adjustment, inspection, maintenance, modification, or use;
- Damage caused by using a product on an unlisted, modified, unsuitable, or incorrectly identified motorcycle;
- Damage caused by misuse, abuse, neglect, racing, competition, stunt use, or unauthorized off-road use;
- Damage caused by another worn, damaged, incompatible, defective, or incorrectly installed component;
- Labour, towing, recovery, diagnostic, storage, travel, accommodation, rental, removal, or reinstallation costs;
- Loss of motorcycle use, riding time, revenue, profit, business, opportunity, data, or goodwill; or
- Indirect, incidental, special, exemplary, punitive, or consequential damages.
To the fullest extent permitted by law, our total combined liability for any claim relating to a product, order, website use, or customer-service communication will not exceed the amount actually paid to XS650Direct for the specific product giving rise to the claim.
These limitations apply regardless of whether a claim is based on contract, warranty, negligence, product liability, misrepresentation, statute, or another legal theory, and even if the possibility of loss was known or reasonably foreseeable.
18. Customer Responsibility, Release and Indemnity
To the fullest extent permitted by law, the customer accepts responsibility for the motorcycle, the selected product, the accuracy of motorcycle information supplied to us, the choice of installer, and the inspection, installation, adjustment, testing, maintenance, and lawful use of the product.
To the fullest extent permitted by law, the customer releases XS650Direct and their owners, directors, officers, employees, representatives, suppliers, contractors, and service providers from claims arising from the customer’s or installer’s incorrect product selection, improper installation or maintenance, use on an unlisted application, modification, misuse, unlawful use, failure to stop using a product after a warning sign appears, or inaccurate information supplied by the customer.
To the fullest extent permitted by law, the customer agrees to defend, indemnify, and hold harmless XS650Direct and their owners, directors, officers, employees, representatives, suppliers, contractors, and service providers from third-party claims, liabilities, losses, damages, and reasonable legal costs caused by the customer’s unlawful conduct, material breach of these terms, improper installation or resale of a product, misuse of a product, or intentional misconduct.
This section does not require a customer to release or compensate XS650Direct for liability caused solely by our fraud, wilful misconduct, or other conduct for which liability cannot legally be excluded.
19. Website Use and Intellectual Property
Website text, photographs, graphics, logos, guides, downloads, product organization, and other original content are owned by or licensed to XS650Direct and are protected by applicable intellectual-property laws.
The website may be used for personal shopping and informational purposes. Website content or systems may not be copied, scraped, republished, sold, commercially exploited, interfered with, or misused without written permission.
Yamaha, XS650, XS1, XS1B, XS2, TX650, Standard, Special, and other manufacturer or model names may be trademarks of their respective owners. Their use identifies product compatibility and does not imply sponsorship or endorsement unless expressly stated.
20. Third-Party Services, Privacy and Identity Resolution
The website may use or connect with third-party services, including Shopify, payment providers, couriers, financing providers, product-review services, return-management and shipment-protection providers, fraud-screening services, analytics providers, advertising platforms, consent-management tools, email and messaging platforms, identity-resolution providers, and marketing-data providers.
Personal information is collected, used, disclosed, retained, and protected according to our Privacy Policy, which forms part of these Terms & Conditions.
We and our service providers may use cookies, pixels, tags, scripts, server-side technologies, browser or device identifiers, and similar technologies to operate and secure the website, understand website use, prevent fraud, measure performance, personalize content, and support permitted advertising and marketing.
For certain visitors located in the United States, we may use an identity-resolution provider such as OpenSend. The provider may attempt to match website, browser, device, network, or interaction signals with contact information held by the provider or its data partners.
Where the website provides cookie, tracking, data-sharing, or privacy-choice controls, those controls may be used to exercise the available choices.
21. Electronic Communications and Marketing
We may send commercial email or other marketing communications when the recipient has subscribed directly, has a relationship with us that permits the communication, has been identified through a provider that represents it is authorized to supply the contact information for applicable marketing, or when another lawful basis permits the communication.
Marketing messages will include the sender identification, contact information, and unsubscribe or preference mechanism required by applicable law.
A recipient may unsubscribe through the link in a marketing email or by contacting us at help@xs650direct.com. We will process the request as promptly as reasonably practicable and within the period required by applicable law.
After an unsubscribe request, we may retain the email address and limited related information on a suppression list to honour the request, demonstrate compliance, prevent accidental re-addition, and provide the suppression instruction to service providers that send messages on our behalf.
An unsubscribe or marketing complaint may be shared with other stores operated by the same business and their service providers so that the same address is not unintentionally contacted through another store. A purchase, account, inquiry, or subscription at one store does not automatically enrol the person in promotional marketing from every other store.
Opting out of promotional communications does not prevent us from sending permitted transactional or relationship messages concerning an order, payment, shipment, account, return, warranty claim, security issue, legal notice, or customer-service request.
Marketing emails may contain pixels, tracked links, or similar technologies that measure delivery, opens, clicks, device information, and related engagement as described in our Privacy Policy.
22. Messaging
Where you enroll in text messaging or another messaging program, separate messaging terms and privacy terms may apply. Current Postscript messaging terms are available at Messaging Terms and Messaging Privacy Policy.
Consent to receive marketing text messages is not a condition of purchasing products unless expressly permitted by applicable law. Message frequency, carrier rates, opt-out instructions, and other program details are governed by the applicable messaging terms.
23. Privacy Requests and Complaints
Depending on where you live and subject to applicable exceptions, you may have rights to request access, correction, deletion, withdrawal of consent, restriction of certain processing, or an opt-out from targeted advertising, sale, or sharing as those terms are defined by applicable law.
Privacy requests and complaints may be submitted by emailing help@xs650direct.com or through our Contact Us page. We may take reasonable steps to verify identity and authority before completing a request.
If you received an unexpected marketing email or believe an identity, household, browser, device, or email address was matched incorrectly, state that the request concerns an “OpenSend identity match” so that we can review the source, suppress marketing, and make appropriate correction or deletion requests with relevant providers.
We may retain information where required or permitted for legal compliance, accounting, fraud prevention, dispute resolution, warranty administration, return administration, security, recordkeeping, and suppression of future marketing.
Nothing in these Terms & Conditions excludes, limits, or waives a privacy, anti-spam, consumer-protection, or other statutory right that applicable law does not allow us to exclude, limit, or waive.
24. Events Outside Our Control
We are not responsible for a delay or failure caused by circumstances outside our reasonable control, including natural events, severe weather, fire, flood, war, civil disruption, government action, customs delays, carrier interruptions, labour disputes, utility or internet outages, cyber incidents, epidemics, supplier failures, or transportation shortages.
In these circumstances, we may delay, allocate, partially fulfill, or cancel affected orders and refund any amount paid for products we cannot supply.
25. Governing Law
These terms are governed by the laws of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law rules.
Subject to any mandatory consumer rights in the customer’s jurisdiction, disputes will be brought before the courts located in Ontario, Canada.
26. Changes, Severability and Entire Agreement
We may revise these Terms & Conditions to reflect changes to our business, website, policies, products, service providers, or legal obligations. The updated version takes effect when posted and applies to future website use and future orders, except where applicable law requires otherwise.
If any part of these terms is found invalid or unenforceable, that part will be limited or removed only to the minimum extent necessary. The remaining terms will continue to apply. Our failure to enforce a term on one occasion does not waive our right to enforce it later.
These Terms & Conditions, together with the applicable product listing, order information, Return Policy, Shipping Information, Privacy Policy, messaging terms, and any written product warranty, form the agreement relating to use of this website and the purchase of products. If a product listing contains a specific term that conflicts with a general term on this page, the product-specific term applies to that product where permitted by law.
